Biothera Responds to Patent Litigation Statements
EAGAN, MN – March 19, 2008 – Biothera responded today to a news release issued by ImmuDyne, Inc. regarding the companies’ ongoing patent dispute.
- Biothera has more than 40 U.S. patents and patents pending, plus additional filings in more than 20 countries. The recent Texas state court ruling pertains to only five patents.
- A federal court previously ruled that Biothera has exclusive rights to the patents in question. The company is disappointed with the ruling in the Texas district court because it confuses the issue and will extend litigation over the rights of these patents.
- Biothera has a patent infringement lawsuit pending against ImmuDyne in federal court. The court in that case has already found that Biothera has exclusive rights to the patents.
- Biothera will continue to sell ingredients for dietary supplements and functional foods that enhance the immune system.
